Post-collision fatal reporting – privacy notice
This privacy notice sits beneath our top-level privacy notice and provides information about how personal data is used with regards to the data and footage captured as part of an internal post collision fatal investigation on the motorways and major roads of England (commonly known as the strategic road network).

What personal data do we collect and handle?
When a fatal road traffic collision or incident occurs on the strategic road network, or on land which we own, it triggers an internal post-collision fatal reporting process. Part of the process is a site visit within seven days of the incident occurring. As part of the evidence gathering a vehicle may be used to take images or capture footage to visually record the condition of the road and the associated infrastructure.
The data or footage recorded is not designed to capture personal information, however it may inadvertently capture registration numbers and other imagery.
What legally allows us to collect and handle information about you?
Our post collision site visit data and footage is processed for the purposes of internal incident investigation and the legal basis for processing any personal information inadvertently captured by the system(s) falls within Article 6 (1) (e) of the UK General Data Protection Regulation – it is carried out in the public interest to investigate fatal collisions and to protect and improve the safety of road users.
How long do we keep this information for?
Our site visit data and footage is retained for five years.
Who do we share your data with?
Under most circumstances this data will not be shared, however there are some exceptions where we may share or be required to disclose the information with:
- the emergency services for the prevention or detection of crime, or for safety purposes
- as part of police or law enforcement investigations, or court proceedings
Any data sharing will be undertaken in line with the UK General Data Protection Regulation.
